Why is the DPAE mandatory for each new hire?

The Pre-Employment Declaration is a declarative formality for compulsory recruitment in France. Carried out by the employer who recruits a new employee, the DPAE ensures the legality of the hiring in order to fight against hidden work and also guarantees that the employee will benefit from all his social rights as soon as he enters the company.

When should the DPAE be submitted to Urssaf?

The DPAE must be sent to Urssaf no earlier than 8 days prior to the foreseeable date of hiring the employee and at the latest when the employee takes office.

How do I make a Pre-Employment Declaration?

Does the DPAE apply to all types of contracts?

Your employees hired on a permanent contract, a fixed-term contract, seasonal contract, work-study contract, extra contract or very short-term contract are subject to the DPAE. Only interns are an exception and do not require a declaration to URSSAF.

Is the DPAE necessary for apprenticeship contracts?

Apprentices or work-study students are considered to be fully-fledged employees, so they must be subject to a DPAE from URSSAF.

Who should do the DPAE for temporary workers?

For temporary contracts, it is up to the temporary employment company (ETT) to declare its permanent staff and temporary staff.

Is the DPAE necessary for a renewal of a CDD?

Each new hiring of the same employee must be the subject of a prior declaration, unless the person concerned is hired by successive contracts carried out without interruption. In concrete terms, if both contracts concern the same workstation and if there is no interruption at the end of the first contract, it is not necessary to register a new DPAE.

How do I change a DPAE?

In the event of an error, you can change an employee's DPAE within 2 working days after confirmation of receipt from URSSAF. Log on to your online space URSsaf.fr. Click on Account then Hiring then Modifying a DPAE. Make the necessary changes in the appropriate fields and then validate the update according to the instructions. Only information concerning the employment contract can be changed. To change other information, such as the address, the company name of the establishment or the SIRET number, you must file a new declaration.

How do I cancel a DPAE?

If it is possible to modify a DPAE, the employer cannot cancel it. If an employee does not finally join the workforce, then the pre-employment declaration will automatically no longer have any effect. No action is necessary with URSSAF.

What are the sanctions in case of non-compliance with a DPAE?

As an employer, if you do not take this step, you are exposed to civil, administrative and criminal sanctions of up to 3 years in prison and a fine of 45,000 euros per undeclared employee.
